1. Information we collect

Information you provide

We collect information you give us, such as your name, email address, phone number, mailing address, payment information, delivery requests and notes, and information included in support messages.

Information from your use of the Services

• Location: We collect location information you provide. With your device permission, we may also collect precise device location while the app is in the foreground or background.
• Transactions: We collect details about services and deliveries, including the service requested, its date and time, charges, and related transaction records.
• Usage and preferences: We collect information about interactions with the Services and the preferences and settings you select. Our websites and Services may use cookies, pixels, or similar technologies for this purpose.
• Device information: We may collect device model, operating system, software versions, language, device and advertising identifiers, serial number, motion information, and mobile network information.

2. How we use information

We use information to operate and improve the Services, coordinate deliveries, process payments, send receipts, authenticate users, provide support, develop features, and send service updates. We also use it to prevent fraud, investigate technical problems, and analyze service performance and usage.

3. How we share information

We may share information in the following circumstances:

• With construction material transporters and other parties involved in fulfilling a requested service.
• With partners providing a service or promotional offer you request, and with integrations or other parties you authorize.
• With BPI affiliates and service providers, including vendors, consultants, and marketing partners, that need information to work on our behalf.
• To comply with legal obligations or requests from authorities, enforce our agreements, or protect people's rights, property, or safety.
• As part of a proposed or completed business sale, merger, financing, or reorganization.
• With your consent, or in an aggregated or de-identified form that cannot reasonably identify you.

Third parties that receive personal information from us must provide protection consistent with this policy and applicable privacy requirements.

4. Data retention and deletion

We retain personal information for as long as needed to provide the Services and fulfill the purposes described in this policy, including meeting legal, accounting, and recordkeeping obligations, resolving disputes, and enforcing agreements. The retention period depends on the type of information and why we hold it.

You can initiate deletion of your account directly in the Cubic Yard driver app using the account deletion option. You do not need to call or email support to initiate account deletion. We may ask you to verify your identity and confirm your request.

Account deletion includes deletion of the personal information associated with your account, except information we are required or permitted by law to retain. Any retained information is kept only for those purposes and for as long as necessary. If processing your request takes additional time, we will explain the expected timeframe and confirm when deletion is complete.

You can also request deletion of your CY Deliver account online without installing or signing in to the app.

5. Your choices

Contact us to request access to, correction of, or deletion of your personal information, or to withdraw consent to processing based on consent. We handle these requests in accordance with applicable law.

You can change or revoke location access in your device's settings. Disabling access may affect features that rely on location. Browser settings let you manage cookies.

To stop promotional messages, follow the unsubscribe instructions in those messages. We may still send communications about your account, requested services, or our ongoing business relationship.

6. California privacy rights

California residents may request information about disclosures of personal information for third parties' direct marketing. BPI does not share personally identifiable information for those parties' own direct marketing without your consent.

7. Changes to this policy

We may update this policy as our Services and practices change. We will update the effective date above and notify you of significant changes through the Services, email, or another appropriate method. Please review this page periodically.
